Grant of Continuing Authority from COMELEC to Appoint, Hire New Employees, and Transfer or Detail Officers and Employees in the DepEd in connection with the 2023 Barangay and SK Elections

1. For the information and guidance of all concerned, enclosed is a copy of Memorandum No. 23-06983 from the Commission on Elections (COMELEC) Law Department dated September 25, 2023, approving the request for the Grant of Continuing Authority to Appoint or Hire New Employees, and Transfer or Detail Officers and Employees of the Department of Education (DepEd) in connection with the 2023 Barangay and Sangguniang KabataanElections.

2. The approval of the grant of continuing authority is subject to the conditions set forth by the COMELEC, to wit:

a. That this authorization shall be limited to orders to appoint, hire new employees, and to transfer or detail officers and employees of DepEd in its central, region, division, and school offices, signed and issued by the Secretary of Education or Atty. Michael Wesley T. Poa as DepEd Undersecretary and Chief of Staff;

b. That the said appointment or hiring, and transfer or detail is essential to the proper functioning of the office and shall not in any manner influence the conduct of the October 30, 2023 Barangay and Sangguniang Kabataan Elections;

c. That the same shall not involve promotion or the giving of any increase of salary or renumeration or privilege which is strictly prohibited during the forty five (45)-day period before the October 30, 2023 Barangay and Sangguniang Kabataan Elections, without any exception whatsoever;

d. That this authorization shall be prospective in application and without prejudice to the applicable Civil Service Law, rules and regulations on personnel actions/movements; and

e. That the proper notices presc1ibed and required under Section 393(d) of Resolution No. 10924 shall be promptly sent to this Commission through this Department.

3. The grant of continuing authority shall apply to appointment, hiring and transfer or detail of personnel in all levels of governance in the Department.

4. In relation to the foregoing, the signing authorities on appointment, hiring, and transfer or detail as Sections A and B (Annex C) of DepEd Order No. 001, s. 2023 titled Revised Designation of Undersecretaries and Assistant Secretaries to their Strands and Functional Areas of Responsibilities and Revised Signing Authorities are temporarily suspended during the election period. All appointments, hiring and transfer or detail shall be submitted to the Office of the Secretary through the Office of the Undersecretary for Human Resource and Organizational Development.
